Welcome to Cloud99! These Terms of Service ("Terms") govern your use of our mobile application and services. By using Cloud99, you agree to these Terms.
1. Acceptance of Terms
By creating an account or using Cloud99, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our service.
2. Eligibility
You must be at least 18 years old to use Cloud99. By using our service, you represent that you meet this age requirement.
3. Account Registration
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the security of your account credentials
- You are responsible for all activities under your account
- You must notify us immediately of any unauthorized access
- One account per person; sharing accounts is prohibited
4. Service Description
Cloud99 provides AI-powered date night itinerary planning services. Our service:
- Generates personalized date itineraries based on your preferences
- Provides venue recommendations with real locations and times
- Uses AI algorithms to match your preferences with available options
- Offers free tier, one-time purchase, and subscription options
Important: Cloud99 provides suggestions and recommendations only. We are not responsible for the actual venues, their availability, quality, or your experience. Always verify venue information independently.
5. Pricing and Payment
5.1 Free Tier
- New users receive 1 free date itinerary generation
- Limited to one per account
- Subject to service availability
5.2 One-Time Purchase
- $3.99 per date itinerary generation
- Credits do not expire
- Purchases are final and non-refundable except as required by law
5.3 Premium Subscription
- $9.99 per month
- 5 date generations per week (resets every Monday)
- Billing through Apple App Store
- Auto-renews unless cancelled at least 24 hours before renewal
- Cancel anytime through your App Store account settings
- No refunds for partial months
5.4 Payment Processing
All payments are processed through the Apple App Store. You agree to Apple's payment terms and conditions. We do not store your payment information.
6. Subscription Terms
- Subscriptions automatically renew at the end of each billing period
- You will be charged through your App Store account
- To cancel, go to your App Store account settings at least 24 hours before renewal
- Cancellation takes effect at the end of the current billing period
- Weekly credit limits reset every Monday at 12:00 AM PST
- Unused weekly credits do not roll over
7. Refund Policy
- One-time purchases are generally non-refundable
- Subscriptions are non-refundable for partial periods
- Refunds may be granted at our discretion for technical issues
- Contact support@cloud99.app for refund requests
- Apple's refund policies also apply
8. User Conduct
You agree NOT to:
- Use the service for any illegal purpose
- Attempt to hack, reverse engineer, or exploit the service
- Share your account with others
- Use bots, scrapers, or automated tools
- Submit false, misleading, or inappropriate information
- Harass, abuse, or harm other users or our team
- Resell or redistribute our service
- Circumvent payment systems or credit limits
9. Intellectual Property
- Cloud99 and all related trademarks, logos, and content are our property
- AI-generated itineraries are provided for your personal use only
- You may not reproduce, distribute, or commercialize our content
- You retain ownership of information you provide to us
- By using the service, you grant us a license to use your data to provide services
10. Disclaimers and Limitations
IMPORTANT - READ CAREFULLY:
10.1 Service Provided "As Is"
Cloud99 is provided "as is" and "as available" without warranties of any kind, express or implied, including:
- No guarantee of accuracy, completeness, or reliability of venue information
- No guarantee of service availability or uptime
- No guarantee that generated itineraries will meet your expectations
- No warranty of fitness for a particular purpose
10.2 Venue Information
We provide venue recommendations based on third-party data sources. We do not:
- Guarantee venue availability, hours, or pricing
- Endorse or take responsibility for any venue
- Guarantee the quality of venues or your experience
- Take responsibility for reservations or bookings
10.3 Limitation of Liability
To the maximum extent permitted by law, Cloud99 and its affiliates shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or use
- Personal injury or property damage resulting from use of venues
- Issues arising from venue closures, changes, or inaccuracies
- Any damages exceeding the amount you paid us in the last 12 months
11. Indemnification
You agree to indemnify and hold harmless Cloud99, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the service
- Your violation of these Terms
- Your violation of any third-party rights
- Your experiences at any recommended venues
12. Termination
We may suspend or terminate your account at any time for:
- Violation of these Terms
- Fraudulent activity or payment issues
- Abusive behavior
- Any reason at our discretion with notice
You may delete your account at any time through the app settings. Upon termination:
- Your access to the service will end immediately
- Unused credits and subscription time will be forfeited
- Your data will be deleted per our Privacy Policy
13. Changes to Service and Terms
We reserve the right to:
- Modify or discontinue the service with notice
- Change pricing with 30 days notice (existing subscribers grandfathered)
- Update these Terms (material changes require notice)
- Add or remove features
Continued use after changes constitutes acceptance of new Terms.
14. Third-Party Services
Our service integrates with third-party services (Google Places, OpenAI, etc.). These services have their own terms and conditions. We are not responsible for third-party services or their availability.
15. Dispute Resolution
15.1 Informal Resolution
Before filing a claim, please contact support@cloud99.app to resolve the issue informally.
15.2 Binding Arbitration
Any dispute will be resolved through binding arbitration rather than in court, except you may assert claims in small claims court. You waive your right to a jury trial or class action.
15.3 Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
16. Miscellaneous
- Entire Agreement: These Terms constitute the entire agreement between you and Cloud99
- Severability: If any provision is invalid, the rest remains in effect
- No Waiver: Failure to enforce any right does not waive that right
- Assignment: You may not transfer your account; we may assign our rights
- Force Majeure: We are not liable for delays due to circumstances beyond our control
